“Mumty Bumpty” means Mumty Bumpty whose registered address is York Hub, Popeshead Court Offices, Peter Lane, York, North Yorkshire, YO1 8SU, United Kingdom.
“You” and “Your” means you the person entering into this agreement with Mumty Bumpty.
2. User Obligations

You will not directly or indirectly act or omit to act in any way which may infringe, damage or endanger any intellectual property rights (or any goodwill attaching thereto) of Mumty Bumpty or any third party which may now or in the future subsist in any part of the world and will not knowingly permit any other person to do so.

All payment transactions are handled through PayPal (please see above website for details of encryption they operate). Please note that this Site does not encrypt any data You may forward to Mumty Bumpty. Therefore information submitted to Mumty Bumpty over this Site is normally unprotected until it reaches us and You are advised not to send confidential information by email unless specifically requested by Mumty Bumpty.
6. Force Majeure
You expressly absolve and release Mumty Bumpty from any claim of harm resulting from a cause beyond Mumty Bumpty’s control, including, but not limited to, the failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, computer viruses, unauthorized access, theft, operator errors, severe weather, earthquakes, or natural disasters, strikes or other labour problems, wars, terrorism, or governmental restrictions.

8. Our contract
When you place an order to purchase a product from Mumty Bumpty, we will send you an email confirming receipt of your order and containing the details of your order. That email will also confirm the cost of delivery which will be added to the purchase price. You will also receive a confirmation from PayPal which will be an indication that your purchase has been completed.
Your order represents an offer to us to purchase a product which is accepted by us when we despatch that product to you and is confirmed by an email we send to you confirming that we have despatched the goods (the ‘Despatch Confirmation E-mail’). That acceptance will be complete at the time we send the Despatch Confirmation Email to you. Any products on the same order which we have not confirmed in a Despatch Confirmation Email to have been despatched do not form part of that contract. 9. Pricing and availability
We list availability information for products sold by us on the website, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. As we process your order, we will inform you by email if any products you order turn out to be unavailable.
12. Variation of content of the Site
Mumty Bumpty reserves the right at any time and without notice to remove, amend or vary any of the content which appears on any page of the Site.
If any part of these terms and conditions is determined to be invalid or unenforceable that will not affect the viability and enforceability of any remaining condition.
A failure by Mumty Bumpty to exercise or enforce any rights under these terms shall not be deemed to be a waiver of any such rights or operate so as to bar the exercise or enforcement thereof at any subsequent time or times.
15. Term and Termination
This agreement will take effect at the time You begin using the Site (thereby indicating acceptance of this Agreement). Mumty Bumpty reserves the right at any time and for any reason to deny You access to the Site or any part of it and to terminate this agreement. Termination will be effective without notice.
16. Entire Agreement
Save in case of fraudulent misrepresentation or fraudulent concealment, these terms and conditions set out the whole of the Agreement relating to use of and access to the Site. They may not be varied by You at any time.
17. Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with English law. Disputes arising in connection with this Agreement shall be subject to the exclusive jurisdiction of the English courts.
18. Delivery, Postage and Packing
We aim to deliver all orders within 14 days, however please allow 28 days for delivery. Deliveries are made either by a carrier such as Royal Mail or Parcel Force depending on the weight of the item. Some deliveries may require a signature.
Please review our Returns Policy, which applies to products purchased from us. In some countries you may have a statutory right to return goods during an initial cooling off period as an alternative to our Returns Policy. If you would like to exercise any statutory right of return please let us know.
20. Damaged / Lost Claims
In the rare event of damage, all packaging must be kept for inspection. The item must be available for inspection in the state it was delivered, at the address it was delivered to. If the item is moved / repaired or if the packaging is not kept, any claim will be voided. In this instance You would still be liable for the full amount.
